Terms of Service

1. The Service

listenAB is a free, browser-based tool for comparing (A/B testing) multiple audio files. You load your audio files into your browser, and the tool plays them in sync so you can switch between versions to hear the differences.

2. Use

The service is free of charge and requires no account. You may use it for personal and commercial purposes.

3. Your Files

Your audio files are loaded into your browser's memory and processed locally. They are never uploaded to, stored on, or transmitted to our server. When you close the browser tab, all files are gone.

You retain full ownership and all rights to your audio files. You grant us no license or right to your files beyond what is necessary for the tool to display and play them in your browser.

4. Warranty

The service is provided "as is" without warranty of any kind, whether express or implied. This includes but is not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

5. Liability

Our liability is limited as follows:

• For intent and gross negligence: unlimited liability.
• For minor negligence: liability is limited to typical, foreseeable damages arising from the type of breach.
• For slight negligence: liability is excluded, except for breaches of cardinal duties (essential obligations under the contract).
• Total liability is capped at €5,000 per claim.

Full statutory liability always applies for:

• Personal injury (life, body, health)
• Defects in a guarantee
• Liability under the German Product Liability Act (Produkthaftungsgesetz)
• Fraud or intentional concealment of defects

6. Changes and Discontinuation

We may modify, suspend, or discontinue the service at any time without prior notice. Since the service is free and no account is required, no data is lost when the service changes or ends.

7. Governing Law

These terms are governed by German law. The place of jurisdiction is Deggendorf, Germany, unless the counterparty is a consumer with their habitual residence in Germany, in which case their place of residence applies.
